The purpose of the Courthouse Overlay zone is to encourage growth and infill redevelopment, while preserving and protecting the unique features and characteristics of the area surrounding the courthouses downtown.


The Courthouse Overlay Board, and if necessary the Planning Commission, achieves this goal by using applicable design standards and “authorization permit” requirements to approve or disapprove development proposals in the zone.

Despite this intent, current process allows applicants to demolish buildings and proceed with development activity BEFORE the Planning Commission hears, on appeal, a decision of the Courthouse Area Design Review Board. As such, the “meat” of an appeal can be torn-down, irreversibly altered, or displaced before a party to the action has his/her proverbial “second-bite at the apple”.

This unfortunate circumstance occurred during the recent CentrePointe controversy, in which the developer destroyed buildings on the Woolworth Block while community interests appealed the Courthouse Area Design Review Board’s ruling—which granted a demolition permit—to the Planning Commission.

In response to this wake-up call, the Planning Commission initiated and yesterday ADOPTED a text amendment to the zone, that prohibits the demolition, building, or issuance of other development permits prior to filing and/or completion of an appeal from the Courthouse Area Design Overlay Board to the Planning Commission.

The Fayette Alliance strongly supported this text amendment, and the Planning Commission recommended its adoption on June 25th, 2009.  The Council formally adopted it on July 7th, 2009 and it is now law.

The Alliance strongly supports the Downtown Masterplan, and aims to participate in those LFUCG discussions that will recommend ordinances and programs to the Council for adoption.  Such legislation will give the Masterplan “teeth” and establish a broad regulatory framework for redeveloping downtown.  We’ll keep you posted.

3rd Annual Bluegrass International Cup at Polo In The Park

The 3rd Annual Bluegrass International Cup at Polo in the Park, was held on Saturday, July 18th, 2009 to benefit the crucial efforts of Bluegrass Conservancy and The Fayette Alliance.

Over 750 supporters attended the benefit at the Kentucky Horse Park’s scenic Man o’ War field, and watched an exciting polo match between Baroness’ Team U.S.A. and Gainesway Farm’s Team South Africa. Team U.S.A. scored the winning goal in the last minute of the match, prevailing over South Africa 10-9.

Party goers also enjoyed dinner, live music by popular 80’s cover band “The Spazmatics”, and a silent and live auction featuring an exclusive painting by acclaimed local artist Andre Pater, along with other unique field-sport experiences.

The Bluegrass International Cup had unprecedented success this year, by doubling corporate sponsorship and raising substantial funds for Bluegrass Conservancy and The Fayette Alliance.

Director Knox van Nagell attended the Chamber’s leadership trip to Madison, WI.

Madison is a great city with a vibrant, human scale downtown.  It also has a thriving university, extensive bike trails, and a flourishing $9 billion agricultural economy… All it takes is innovative planning and visionary leadership!  Needless to say, The Alliance looks forward to promoting Madison’s lessons here in the Bluegrass.
